1. Sweepstakes Period: From 6:00 p.m. ET on 2/1/10 through 11:59 p.m. ET 1/2/11 ("Promotion Window"), there will be forty-eight (48) weekly sweepstakes periods (each a "Weekly Sweepstakes"). A "Week" is defined as the seven- (7-) day period beginning at 12:01 a.m. ET on each Monday and ending at 11:59 p.m. ET each Sunday throughout the Promotion Window, with the exception of Week 1 where the Week will begin at 6:00 p.m. ET Monday 2/1/10. Entry into each Weekly Sweepstakes is based upon your weekly participation in the Let's Fix Dinner™ Challenge (the "Challenge").
2. How to Enter: Access www.letsfixdinner.com and follow the on-screen instructions to register and participate in the Let's Fix Dinner™ Challenge. All entrants must have a valid e-mail address. If you have chosen to participate in the Challenge, you will receive one (1) entry into the then-current Weekly Sweepstakes when you log in to your Challenge account and update your dinner tracker. Each entry is only eligible for inclusion in the Weekly Sweepstakes corresponding to the Week the entry was made. Limit one (1) entry per person and per e-mail address, per Week, regardless of whether more than one person uses the same e-mail address or updates their dinner tracker more than once each Week. Each person may only use one (1) e-mail address to participate in this Sweepstakes, and such e-mail address may only be used by one person regardless of whether the e-mail address is shared by two or more people. Any person who uses more than one (1) e-mail address to enter the Sweepstakes may be disqualified and prizes won may be forfeited subject to Sponsor's sole discretion. Automated entries are prohibited and any use of such automated devices will cause disqualification. In case of dispute as to identity of the winner who enters, entry will be declared as the registered user (meeting eligibility criteria) of the e-mail account and, if a prize is won, it will be awarded to that registered user. Weekly Sweepstakes entries will NOT be carried over to the subsequent Weekly Sweepstakes.
3. Weekly Prizes: A) There will be a total of ninety-six (96) Weekly Prizes ("Weekly Prizes"), two (2) prizes awarded per Weekly Sweepstakes. Weekly Prizes will be awarded as follows:
Weeks 1–12 (2/1/10–4/25/10) – Two Weekly Prizewinners will each receive four (4) free (up to $8.99) STOUFFER'S® entrées and a $50 merchandise prize (the "Prize") from the Let's Fix DinnerTM Prize Center (the "Prize Center"; for full details, see Section 3.B.2). Approximate Retail Value ("ARV") of each Weekly Prize for Weeks 1–12 is $86; total ARV of all prizes each Week is $172. Total ARV of all Prizes for weeks 1-12 is $2,064.
Weeks 13–24 (4/26/10–7/18/10) – Two Weekly Prizewinners will each receive four (4) free (up to $8.99) STOUFFER'S® entrées and a $100 prize from the Prize Center. ARV of each Weekly Prize for Weeks 13–24 is $136; total ARV of all prizes each Week is $272. Total ARV of Prizes weeks 13-24 is $3,264
Weeks 25–36 (7/19/10–10/10/10) – Two Weekly Prizewinners will each receive four (4) free (up to $8.99) STOUFFER'S® entrées and a $300 prize from the Prize Center. ARV of each Weekly Prize for Weeks 25–36 is $336; total ARV of all prizes each Week is $672. Total ARV of Prizes weeks 25-36 is $8,064.
Weeks 37–48 (10/11/10–12/31/10) – Two Weekly Prizewinners will each receive four (4) free (up to $8.99) STOUFFER'S® entrées and a $500 prize from the Prize Center. ARV of each Weekly Prize for Weeks 37–48 is $536; total ARV of all prizes each Week is $1,072. Total ARV of Prizes weeks 37-48 is $12,864.
B) Prizewinners will receive their prizes via two methods:
1) The STOUFFER'S® entrées will be awarded in the form of four (4) free coupons, good for one (1) entrée up to $8.99, mailed to the winner's home address as provided at the time of winner verification.
2) Merchandise prizes will be awarded via an e-mail that will direct the winners to the Let's Fix DinnerTM Prize Center Web site (the "Prize Center"). The e-mail will contain a unique code that the winner will use to redeem his/her prize (the "Prize Code") and instructions on how to redeem the prize using the Prize Code at the Prize Center. Each prizewinner will have to register and create an account on the Prize Center and enter his/her unique code to choose the prize. Registration on the Prize Center is free. The Prize Center will show the merchandise prize choices available at the prize level open to the winner, based on the amount of winner's Weekly Sweepstakes prize. There will be a choice of merchandise prizes available for each prize level. Sponsor will try to ensure the availability and reasonable supply of all merchandise prizes, but reserves the right to modify the merchandise prizes available for redemption at any time. All Prize Codes must be redeemed between 12:00 a.m. ET 2/7/10 and 11:59 p.m. ET 3/31/11 (the "Redemption Period"). Prize Codes may be redeemed for a merchandise prize only at the level open to winner. You may visit the Prize Center as often as you wish during the Redemption Period, but once the winner clicks the PLACE ORDER button, no changes may be made. All Prize Code redemptions are final. No refunds or exchanges will be permitted. Please allow 6–8 weeks for delivery of merchandise prizes from the Prize Center. If, for any reason, a prize from the Prize Center is received damaged, becomes unavailable or cannot be fulfilled, Sponsor, in its sole discretion, reserves the right to replace the item with a similar item of equal or greater value. Should there be a problem with the chosen prize, which requires return or exchange, any such action will occur at the sole discretion of the Sponsor. Winners must redeem all Prize Codes before the expiration of the Redemption Period (11:59 p.m. ET, 3/31/11) unless otherwise extended or modified by Sponsor in its sole discretion. In the event the winner does not redeem the Prize Code by expiration of the Redemption Period, the Prize Code and any prize will be forfeited in their entirety without compensation.
No cash will be exchanged for any winner's Prize Code or portion thereof. No cash substitutions for any prize will be permitted and all prizes are nonrefundable and nontransferable, except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Total ARV for all Weekly Sweepstakes Prizes is $26,256. All prizes will be awarded if the number of eligible entries received for each Weekly Sweepstakes is equal to or greater than the number of prizes available. Limit one (1) prize per person/e-mail address during the Promotion Window. Federal, state and local taxes are solely the responsibility of the winner.
4. Weekly Winner Selections/Odds: Potential Weekly Prizewinners (two (2) winners per Weekly Sweepstakes) will be selected in forty-eight (48) individual random drawings, each held approximately seven (7) days after the close of each Weekly Sweepstakes entry period, from all eligible entries received for that Week. Potential winners will be notified within three (3) business days of the drawing, at the e-mail address entered at the time of the Challenge registration. All winners are subject to verification. If a potential winner does not respond within the time specified in the e-mail notification or cannot accept the prize as stated, the prize will be forfeited in its entirety and an alternate winner may be selected from the applicable Weekly Sweepstakes entry pool. Weekly Sweepstakes entries will NOT be carried over to the subsequent Weekly Sweepstakes. Odds of winning a Weekly Prize depend on the number of eligible entries received for each Weekly Sweepstakes.
By entering this Sweepstakes, entrants accept and agree to these rules and the decisions of the judges, which shall be final. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. Potential winners may be required to sign a Winner's Agreement and Release, and return it by date specified or prize will be forfeited in its entirety. By submitting an entry, winner agrees to allow the use of his or her name, likeness and/or biographical information for promotional purposes, except where prohibited.
5. Eligibility: Sweepstakes is open to legal residents of the 50 U.S. and the District of Columbia, 18 years of age or older, except employees and the families of Nestlé USA, Nestlé Prepared Foods Company, their affiliates, subsidiaries, promotion and advertising agencies. Nestlé USA, Nestlé Prepared Foods Company, their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by each prizewinner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Subject to all federal, state and local laws. Void where prohibited or restricted by law.
6. Other Conditions: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kind, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Sweepstakes in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. Sponsor reserves the right to withdraw the transmission of this Sweepstakes at any time and award the prize(s) from among eligible entries received prior to the date of the withdrawal. Sponsor is not responsible for lost, late, incorrect or inaccurate entry information or Sweepstakes entries, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human errors, which may occur in the processing of the entries in the Sweepstakes. No mass entries or mechanically reproduced entries will be accepted. Any attempts by an individual to access the Web site or Sweepstakes via a bot script or other brute-force attack will result in that IP address, e-mail address and/or person becoming ineligible. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or Web site, to be acting in violation of the Rules, or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement, or any other unfair playing practices or poor sportsmanship, or intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
